The market supervision bureaus (departments, committees) of all provinces, autonomous regions, municipalities directly under the Central Government and Xinjiang Production and Construction Corps, and all relevant food safety sampling inspection agencies:
According to the "the People's Republic of China Food Safety Law" and other relevant laws and regulations, the General Administration of Market Supervision organized and formulated the "2019 Food Safety Supervision and Sampling Inspection Plan." It is hereby issued for implementation.

In order to thoroughly implement the spirit of the 19th National Congress of the Communist Party of China and scientifically standardize the food safety sampling work, in accordance with the the People's Republic of China Food Safety Law and the 13th Five-Year National Food Safety Plan, combined with the actual work, the 2019 food safety supervision sampling plan is formulated.
1. work objectives
Guided by Xi Jinping's thoughts on socialism with Chinese characteristics in the new era, the implementation of the "four strictest" as the fundamental follow, the goal of making people eat at ease, the promotion of "double random, one open" as a means, and innovative food safety supervision The way is the driving force, guided by the discovery of food safety problems, effectively prevent and control systemic, regional and industrial food safety risks, and further implement the main responsibility of corporate food safety, promote the healthy and orderly development of the food industry.
2. working principle
(I) stick to the problem orientation. The basic principle of supervision and sampling inspection is to find problems and prevent and control risks. Increase the frequency of random inspections of high-risk foods and foods with low pass rates, increase the intensity of random inspections of agricultural and veterinary drug residues, heavy metal residues, and biotoxin pollution, and strengthen random inspections of key areas such as agricultural product wholesale markets and campuses to improve problem detection rate.
(II) insist on broad coverage. Point-to-surface combination, overall consideration. Efforts should be made to realize the supervision and sampling inspection covering different areas such as urban, rural and urban-rural areas, covering all food categories, varieties and fine categories, covering food production enterprises with certificates in production, and covering different formats such as production, circulation, catering and online sales.
(III) adhere to the combination of inspection and management. Cooperate with daily supervision and special rectification, focus on hot spots of public opinion, and organize and carry out special supervision and sampling inspection in a timely manner; Combined with the problems found in daily supervision such as flight inspection and system inspection, as well as the release of laws and regulations, the implementation of food quality improvement projects, HACCP certification of food enterprises, etc., timely adjust the sampling tasks; Strengthen the interconnection and sharing of supervision and sampling and daily supervision information, carry out consultation and joint management.
(IV) adhere to the four linkage. The national, provincial, municipal and county levels work closely together, with a reasonable division of labor and different focuses. The General Administration is mainly responsible for the sampling inspection of products of food production enterprises above the scale or with a large market share. The provincial (regional, municipal) bureau is mainly responsible for the product sampling inspection of all food production enterprises in production and obtaining licenses in their administrative areas. The municipal and county bureaus are mainly responsible for the sampling inspection of agricultural and veterinary drug residues in edible agricultural products such as vegetables, fruits, livestock and poultry meat, aquatic products, fresh eggs and other edible agricultural products with a certain scale of market sales in their administrative areas, as well as the sampling inspection tasks of small enterprises, small workshops and catering units. Market supervision departments at all levels should uniformly implement sampling plans, uniformly dispatch sampling tasks, uniformly standardize procedures and standards, and unify data analysis and utilization. Local governments are encouraged to arrange local special sampling tasks according to the characteristics of regions, industries and consumption on the basis of ensuring sampling plans.
3. work tasks
The 2019 food safety sampling plan covers 34 food categories, 150 food varieties and 259 food fine categories, with a total of 1.3396 million batches. The specific arrangements for supervision and sampling inspection are as follows:
Tasks of the General Directorate of (I) at this level.
The General Administration plans to sample 20600 batches at this level.
1. Sampling objects. Mainly on the national large wholesale market, some key food production enterprises to carry out "double random" sampling. Including 31 categories such as infant formula food, dairy products, meat products, beverages, alcohol, and edible agricultural products (see Annexes 1 and 2 for details). For processed food products, edible oil, dairy products, beverages, wine, biscuits, fried food and nut products, a certain number of online food and imported food will be sampled. Combined with daily supervision, special rectification and public opinion monitoring, special sampling inspection is carried out on the more prominent problems.
2. Sampling time and frequency. The products of all domestic and imported infant formula milk powder manufacturers that have been registered and sold are sampled every month, and the edible agricultural products, online food and imported food are sampled every quarter. The products on the list of food production enterprises sampled by the General Administration are sampled throughout the year, and seasonal foods are sampled before traditional holidays such as New Year's Day, Spring Festival, Lantern Festival, Dragon Boat Festival and Mid-Autumn Festival. In addition, special sampling inspection shall be carried out in combination with specific conditions.
3. Sampling areas, links and places. Mainly in the national circulation link to buy sampling samples. The sampling sites are mainly large agricultural products wholesale markets, large chain supermarkets, large shopping malls, etc., and online food shopping is mainly based on large network platforms.
(II) the tasks of the provincial (district, city) bureau.
Provincial (district, city) bureau sampling 489000 batches. Among them, 226000 batches of special transfer payments were made by the General Administration, and 263000 batches were matched by provincial (regional and municipal) bureaus.
1. Sampling objects. It is mainly for all in-production food production enterprises and large catering enterprises that have obtained production licenses in the province (autonomous regions and municipalities). Strengthen the sampling inspection of enterprises with high market share and large wholesale markets in the province, increase the sampling inspection of food raw materials of catering enterprises, and focus on tracking unqualified enterprises, varieties and projects. Including special dietary food, health food, food processing products, edible oil, meat products, dairy products, beverages, bee products, catering food and other 32 categories (see Annex 1 for details). The sampling inspection of edible agricultural products should highlight the items such as pesticide and veterinary drug residues and heavy metals (see Annex 2 for details).
In principle, the special transfer payment part of the General Administration extracts food produced by the province (region, city), and the matching part of the provincial (region, city) bureau can sample a certain proportion of products from other provinces in the local circulation link.
2. Sampling time and frequency. In principle, the sampling task should be completed in a balanced way throughout the year. Seasonal production and sales of food or food with seasonal quality and safety risks shall be increased in the corresponding season. Sampling inspection of seasonal food should be carried out before the festival.
To increase the frequency of sampling of high-risk food. In principle, the task matching is carried out according to the high-risk food varieties 1:3 and the higher-risk food varieties 1:1. The provincial (district, city) bureaus can make appropriate adjustments according to the local food safety status and specialty foods, and the adjustment task amount does not exceed the matching task 30% of the total. At the same time, it is necessary to increase the frequency of random inspections of food production enterprises that have detected unqualified products in the past. For those who have detected unqualified products twice in a row, the territorial supervision department shall conduct interviews with relevant enterprises.
3. Sampling areas, links and places. The sampling sites shall cover provincial capitals, prefecture-level cities, counties, townships and administrative villages within their respective administrative areas. Sampling samples are mainly purchased in circulation. Samples not drawn in the circulation link can be drawn in the production link. The sampling of circulation links should cover different formats such as wholesale markets, farmers' markets, shopping malls, supermarkets, small grocery stores, etc. The sampling of catering links focuses on the canteens of schools and kindergartens, as well as the central kitchen, collective meal distribution units, and catering service units in tourist attractions.
(III) city and county bureau tasks.
The total number of edible agricultural products sampled by cities and counties nationwide was 830000 batches. The specific task allocation of each city and county is determined by the provincial (district, city) bureau according to the number of local permanent residents and daily supervision.
1. Sampling objects. The sampling varieties of municipal and county bureaus should cover as much as possible the edible agricultural products such as vegetables, fruits, livestock and poultry meat, aquatic products, fresh eggs and other edible agricultural products produced and sold in their respective administrative areas. The sampling items should be determined in combination with the actual supervision needs, and should cover the key items with frequent problems. Appropriately increase the intensity of small workshops, small vendors, small food and beverage sampling.
2. Sampling time and frequency. The Municipal Bureau shall determine the sampling frequency and quantity in proportion to the number of transactions and seasonal characteristics of the wholesale market for edible agricultural products, and in principle cover each household entry seller. The county bureau shall sample vegetables, fruits, livestock and poultry meat, aquatic products, fresh eggs and other edible agricultural products every week.
3. Sampling place. The municipal bureau shall conduct random inspections on the wholesale markets of edible agricultural products above designated size in the administrative area, and the county bureau shall conduct random inspections on the farmers' markets, shopping malls, supermarkets, convenience stores and other business units in the administrative area.
4. job requirements
(I) strengthen organizational leadership. Market supervision departments at all levels should attach great importance to sampling work and strengthen unified leadership and organization and coordination. It is necessary to clarify that specialized agencies and specialized personnel are responsible for sampling work, and to ensure the continuity of work and the stability of personnel. It is necessary to organize forces as soon as possible to carefully refine the sampling tasks according to this plan, formulate implementation plans, improve working mechanisms, standardize work processes, clarify job responsibilities, and ensure that annual tasks are advanced in an orderly manner and completed on time. The higher-level market supervision department should strengthen the supervision and guidance of the lower-level market supervision department, assess the whole process of food safety sampling inspection, and ensure the quality and efficiency of sampling inspection.
(II) standardize the sampling inspection work. Market supervision departments at all levels should fully implement the "double random" requirements, randomly determine the sampling institutions, randomly determine the sampling objects. It is necessary to determine the inspection agency through public bidding or selection in strict accordance with relevant regulations, and carry out inspection and assessment of the inspection agency in strict accordance with relevant regulations. Sampling personnel and inspection agencies must strictly implement relevant laws, regulations, rules and related regulations in the sampling inspection work. Market supervision departments at all levels should actively support the inspection agencies to carry out their work and provide necessary assistance in sample collection and transportation; strictly follow The prescribed time limit and specification requirements submit sampling data. The sampling inspection data of the General Administration's own level, transfer payment tasks and provincial (regional, municipal) bureau matching tasks shall be submitted to the "Food Safety Sampling Inspection Monitoring Information System". The sampling data of edible agricultural products of municipal and county bureaus shall be submitted to the direct reporting module of edible agricultural products of "food safety sampling monitoring information system. If each inspection agency finds that there may be major hidden risks or acute health risks in unqualified samples, it shall report to the market supervision department of the province (region, city) where the sampled unit is located within 24 hours after confirming the inspection results, and copy it to the General Administration.
(III) verification and disposal according to law. After receiving the unqualified food inspection report, the market supervision departments at all levels shall promptly deliver the unqualified report and start the verification and disposal work. If the nonconformity report indicates that it may cause serious harm to health and life safety, the verification and disposal work shall be started within 24 hours. The market supervision departments at all levels shall report the progress of the verification and disposal work in a timely manner through the "Food Safety Sampling and Monitoring Information System". The General Administration of the State Administration of Supervision and Sampling of unqualified food shall report in writing to the General Administration of the State Administration of Food Safety batch by batch according to the time limit and be consistent with the contents of the "Food Safety Sampling and Monitoring Information System. In the process of verification and disposal, it is found that the crime is suspected or involves the responsibilities of other departments, it shall be transferred in a timely manner.
(IV) publish information in accordance with laws and regulations. Market supervision departments at all levels fully implement the "one open", timely release of product sampling information. The provincial (regional, municipal) bureau shall strictly review and publish the information of the sampling results of the administrative region every week in accordance with the requirements of the General Administration. Among them, the product qualification information can provide inquiry service for the public through the data platform, mainly including the name and address of the nominal production enterprise, the name of the sampled unit and the province where it is located, the product name, specification and model, production date/batch number, etc., and it is necessary to indicate that the product qualification information only refers to the production date/batch number and inspected items of the relevant products of the nominal production enterprise in this sampling inspection. Unqualified product information should be announced to the public, in addition to the above information, it also includes the trademark of the nominal product, the name and address of the sampled unit, the unqualified items and results, and the inspection agency. The sampling information of edible agricultural products can be published according to the actual situation, including the name of the sampled unit (the centralized trading market should include the operator and the seller), the name of the product, the source of the purchase, the nominal production enterprise or place of origin, the date of production, etc. Experts shall be organized to interpret the risk of non-conforming products. The provincial (autonomous regional and municipal) bureaus shall monthly summarize the situation and result analysis of food safety sampling inspection in their respective administrative areas last month, and the General Administration shall regularly summarize and publish the situation of national food safety supervision and sampling inspection.
(V) serious work discipline. Market supervision departments, sampling units, inspection agencies and relevant personnel at all levels shall not arbitrarily change the supervision and sampling information, shall not conceal, falsely report or omit inspection data, shall not publish information about supervision and sampling without authorization, shall not notify the sampled units and accept gifts from the sampled units before carrying out sampling work, and shall not use the results of supervision and sampling to carry out paid activities and seek illegitimate interests. Relevant units and personnel shall be investigated for responsibility in accordance with laws and regulations for all illegal and illegal random inspections found.
(VI) other matters. Market supervision departments at all levels should promptly report to the local government the preparation of food safety sampling inspection plans, and strive for special funds to ensure the smooth implementation of sampling inspection work. The food safety sampling inspection tasks of each city separately listed in the plan can be issued by the provincial (district, city) market supervision department or the market supervision department of this city. According to the actual needs of food safety accidents, hot public opinion events, case investigation and handling, timely organization of emergency, law enforcement sampling and other work. The bureaus of all provinces (autonomous regions and municipalities) shall submit the provincial food safety sampling plan or implementation plan to the General Administration before February 18, 2019.
The General Administration may adjust the annual sampling plan according to the situation.
